GENERAL TERMS OF BUSINESS

General information

1. General

Unless otherwise expressly agreed, these GTC apply to all transactions between Epic Snowsports GmbH and the customers. The object of the company is the operation of a snow sports school, an online store ( epic-shop.ch ) & The Epic Shop Priva Alpine Lodge ( Dieschen sot 18, 7078 Lenzerheide ).
Services include snow sports instruction and snow sports guiding, bike instruction and bike guiding, equipment rental, equipment maintenance and merchandise sales.

2. Rental equipment

Material can be received from 08:30 on the first day of rental and must be returned before 17:30 at the end of the last day of rental. For each return after 18:30 the rental costs for another day will be charged additionally.
The customer is responsible and liable for ensuring that his rental material is returned in its original condition. Otherwise, the customer will be charged the cost of service and/or replacement of damaged equipment. If the rental equipment cannot be repaired, the full retail price of the damaged equipment may be charged.
The customer must ensure that the equipment is handled in such a way that it is not accidentally mixed up, stolen or lost. In the event that the rental equipment is accidentally misplaced, stolen or lost, the customer will be charged the full retail price for the rental equipment.
The customer may not transfer the sports equipment to third parties.
The price includes 7.7% VAT.
A change of category is possible at any time subject to availability at an additional charge according to the price list. In case of a change to a lower category, there is no reduction of the price.
In case of delay in receiving the rented material, the customer is required to inform the store concerned as soon as possible. The reserved material will be held back by the Shop until 12:00 noon of the first day of rental at the most. From this time on, the material will be released for rental again without the customer being entitled to any compensation.
Early return of rental property will only be accepted due to a violation and only if the rental property was returned as soon as possible. Early return due to bad weather will not be accepted.

3. Cancellation

All reservations can be canceled free of charge the night before until 18:00.
Cancellations must be made in writing.

4. Liability

Snow sports activities & mountain biking are dangerous sports. Epic Snowsports Ltd. is not liable for accidents, injuries or death of the guests. It is the responsibility of the guest or responsible adult to decide if the risk should be taken.
Insurance is the responsibility of the participant.
Epic Snowsports GmbH is not liable for any damage or loss of the equipment or personal belongings.

5. Jurisdiction

Each party irrevocably agrees to submit to the exclusive jurisdiction of the competent courts of Graubünden (Switzerland) for any claim or matter arising out of or in connection with this Agreement.

6. General online and store conditions.

These general terms and conditions apply to the reservation, booking and payment of rental equipment, snowsport lessons and snowsport guiding or hotel packages via the Internet.
